JAMES THE SECOND by the Grace of God King of these Realms to all to whom these presents shall come, GREETING:
Whereas Our Predecessor King Alexander of happy memory did on the Twenty-fifth Day of June, 2006, promulgate by Royal Proclamation the Constitutional Charter of 2006, thereby constituting various aspects of the State and Government of Our Kingdom of Varennes:
And whereas We did, by and with the advice and consent of all the People of Varennes, by Royal Instrument Under the Great Seal bearing date at Our Court at Valenciennes of Twenty-fourth May 2010, abrogate the said Constitutional Charter of the Kingdom of Varennes of 2006:
And whereas Our Subjects have petitioned Us to constitute anew the various aspects of the State and Government of this Our Kingdom in such a manner that they shall henceforward reflect the Celtic Caledonian, Hibernian, and Cambrian cultures for which Our Peoples in this Realm have expressed an affinity and to which they have an attachment:
LET IT BE KNOWN, therefore, that it is now Our will and pleasure to promulgate for this Our Kingdom the following constitutional Charter:
I. PRELIMINARY
1. All references within this Charter to the “King” or “His Majesty” and any and all other references by which the Sovereign is referred to in the masculine shall also be construed to refer to a regnant Queen (“Her Majesty”) in the event of a female occupant of the Throne.
2. This Charter, and all laws made under it, shall be binding upon all courts, judges, and people of every county and of every part of this Kingdom, notwithstanding anything in the laws of any county; and the laws of this Kingdom shall be in force on all ships sailing from any of His Majesty’s realms, territories or dominions, whose first port of clearance and whose port of destination are in this Kingdom.
3. This Charter shall come into force on the Twenty-fifth day of May 2010, upon which date it shall be gazetted.
II. THE STYLE OF THIS REALM
This Kingdom shall herewith cease to be styled "The Kingdom of Varennes" and shall, instead, forever more be styled "The Kingdom of Sconeland".
III. THE SOVEREIGN
1. His Majesty the King of Hanover is likewise the King in right of Sconeland, who is the Sovereign. The Sovereign is the personification of the State, and shall be known by his royal style and titles proclaimed from time to time. All power and authority emanates from the Sovereign and is exercised in His name.
2. The person of the Sovereign is sacred and inviolable. He shall not be prosecuted.
3. The Sovereign is not responsible. His Ministers are responsible.
4. All ambassadors, consuls and other diplomatic representatives of foreign powers shall be accredited to the Sovereign. Their credentials shall be received by the Sovereign or in the Sovereign’s name in the presence of His representative.
5. The Sovereign is the fount of honour. Honours are bestowed by the Sovereign or by His representative in his name.
6. The Command-in-Chief of the uniformed services of and in Sconeland is vested in the Sovereign.
7. The laws of succession to the Throne shall correspond to the laws of succession of His Majesty’s senior Kingdom of Hanover.
8. In the event that the Kingdom of Hanover shall have in place no clear laws of succession to the Throne upon the demise or abdication of the Sovereign, or in the event that no heir has been appointed by the Sovereign upon his demise or abdication, that person whomsoever the lawful Parliament or Government of the Kingdom of Hanover shall appoint to succeed His Majesty as King of Hanover shall also succeed him as King of Sconeland.
9. In the event that a Regency is proclaimed in the Kingdom of Hanover on account of the minority or incapacitation of the Sovereign, such a Regency shall be likewise acknowledged for and over the Kingdom of Sconeland.
10. Every reference to the Sovereign in any document or instrument in force on or after the commencement of this Charter shall, unless the context otherwise requires, be deemed to include a reference to His Majesty’s heirs and successors.
IV. EXECUTIVE POWER
1. The Executive Government and Authority of and over the Kingdom of Sconeland is vested in the Sovereign and shall be exercised in his name.
2. His Hanoverian and Sconnish Majesty may appoint a Secretary of State for Sconeland who shall render advice to the Sovereign on all matters pertaining to the administration of the Kingdom of Sconeland.
3. There shall be no unique Privy Council for Sconeland.
4. The Sovereign may create public offices from time to time as he shall think fit and shall summon and appoint loyal Sconnish subjects to those offices.
5. Holders of public offices shall, before assuming the duties of their offices, make and subscribe before the Sovereign or some person authorized by him the Affirmation of Loyalty as prescribed in the First Schedule of this Charter.
V. THE LEGISLATURE
1. His Majesty the King in Parliament is the most profound expression of the State, and is the insuperable source of Legislation.
2. There shall not sit a Parliament for the Kingdom of Sconeland that is separate from that of the Kingdom of Hanover.
3. The Acts of His Majesty the King in Parliament, excepting those Acts peculiar to the Kingdom of Hanover, shall be binding within the Kingdom of Sconeland.
4. His Majesty the King shall be free to legislate personally by Royal Proclamation or other Instrument at times when a Parliament cannot be summoned; however Parliament, when convened, shall be free to review and to amend all such unilateral statutory decrees of the Sovereign.
VI. JUDICATURE
1. His Majesty the King, whether in Parliament or in Council, shall be the supreme and final judicial authority of and over the Kingdom of Sconeland.
2. His Majesty the King may constitute subordinate national courts, and local courts, and may appoint judges and legal officers for national and/or local jurisdictions from time to time as he shall think fit.
VII. THE COUNTIES AND OTHER LOCAL COMMUNITIES
1. The Kingdom of Sconeland shall be composed of five Counties as constituted in the Third Schedule of this Charter.
2. His Majesty the King may devise and may grant charters for cities, towns, burghs, and other local communities from time to time as he shall think fit.
VIII. THE SCONNISH PEERAGE
His Majesty the King shall be free to constitute for His Kingdom of Sconeland a Peerage through the creation, by Letters Patent, of any ranks or titles of nobility that he shall think fit from time to time to create.
IX. THE GREAT OFFICERS OF STATE
His Majesty the King shall be empowered to constitute, by Instrument under the Great Seal, the Great Officers of State of the Kingdom of Sconeland and shall appoint, from time to time as he shall think fit, loyal Sconnish subjects to be his Great Officers of State.
X. ALTERATION OF THIS CHARTER
An amendment to or alteration of this Charter shall be made ordinarily by an Act of Parliament, or extraordinarily by Instrument of His Majesty under the Great Seal at times when no Parliament is seated.
SCHEDULES
THE FIRST SCHEDULE.
The Affirmation of Loyalty.
I, A.B., do solemnly and sincerely affirm and declare that I will be faithful and bear true allegiance to His Majesty King James II, His heirs and successors according to law.
(NOTE- The name of the King or Queen for the time being is to be substituted from time to time.)
THE SECOND SCHEDULE.
The Royal Capital.
The Royal Capital of Our Kingdom of Sconeland shall be styled "The City of Tartannac” and shall subside within the County of Caledonia.
THE THIRD SCHEDULE.
The Counties of the Kingdom of Sconeland.
1. Caledonia
2. Meath
3. Cardigan
4. Forth
5. Erin
And for the greater validity and testimony thereof, we do command that there be affixed hereto the Great Seals of Our Kingdoms of Hanover and of Sconeland:
And We desire that these Presents be effective now and in the future; that what is decreed by these Presents be scrupulously observed by those whom they concern and that these Presents attain the purpose for which they are issued:
And that the efficacy of these Presents may not be obstructed by contrary prescriptions of any kind, We herewith abrogate all such prescriptions:
Therefore, if anyone, no matter what his authority, shall either knowingly or unknowingly act contrary to what We have by these Presents ordained and decreed, We command that such acts be considered entirely null and void. Moreover, no one may lawfully efface or destroy these documents of Our will; indeed, to copies of these Presents and extracts therefrom, which bear the seal of an Officer of the Crown and the signature of a public notary, there is to be accorded the very same credence that would be given to these Presents themselves if they were exhibited:
And should anyone contemn or in any manner whatsoever detract from these Presents, let him know that he thereby subjects himself to the penalties established by law for those who do not fulfill the commands of the Sovereign.
Witness Ourself at Wealdstonbury this Twenty-fifth Day of May in the Year of Grace Two Thousand and Ten, the Second of Our Reign.
