An Act to Regulate the Establishment, Registration and Democratic Governance of Major and Minor Political Parties
BE IT ENACTED by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:
Section 1: Citation
1. This bill may be cited as the Political Parties Act (2006).
2. The fourth provision of the Royal Proclamation concerning the October Parliament, concerning political parties, is repealed.
Section 2: Political Parties
1. In this act the term "political party" means a political party registered under this act.
2. No person or group of person shall be regarded as a political party, save subject to conditions prescribed by this act.
Section 3: Registration
1. A political party shall exist by virtue of its enrollment into the Register of Political Parties, which shall be administered by the Lord High Chancellor.
2. During the time for which Parliament shall be composed of the whole population of the Realm, the Lord High Chancellor shall register a political party as a major political party, if he is satisfied that the political party:
a. has at least four members who are citizens of the Kingdom or at least one member who is member of the Cabinet;
b. has a leader elected or recognised by the majority of the members thereof;
c. has legitimate principles that are inconsistent with those of existing political parties;
d. has a written constitution declaring its principles.
3. During the time for which Parliament shall be composed of the whole population of the Realm, the Lord High Chancellor shall register a political party as a minor political party, if he is satisfied that the political party:
a. has at least two members who are citizens of the Kingdom;
b. has a leader elected or recognised by the majority of the members thereof;
c. has legitimate principles that are inconsistent with those of existing political parties;
d. has a written constitution declaring its principles.
4. If, at any time, Parliament has become an elected body, the Lord High Chancellor shall register a political party as a major political party, if he is satisfied that the political party:
a. has at least one member who is a member of Parliament;
b. has a leader elected or recognised by the majority of the members thereof;
c. has legitimate principles that are inconsistent with those of existing political parties;
d. has a written constitution declaring its principles.
5. If, at any time, Parliament has become an elected body, the Lord High Chancellor shall register a political party as a minor political party, if he is satisfied that the political party:
a. has at least two members, none of whom being members of Parliament;
b. has a leader elected or recognised by the majority of the members thereof;
c. has legitimate principles that are inconsistent with those of existing political parties;
d. has a written constitution declaring its principles.
Section 4: Register of Political Parties
The Lord High Chancellor shall enroll any registered political party into the Register of Political Parties, which shall contain the following data for each political party:
a. the name of the political party;
b. a brief explanation of the principles of the political party;
c. a copy of the constitution of the political party;
d. a copy of a current platform of the political party, if such exists;
e. a list of legislation that, prior to its passing in Parliament or failure to pass in Parliament, the political party endorsed;
f. a list of the members of the political party (making special note to recognize the leader of the party).
Section 5: Advancement, Decline and Loss of Status
1. A minor political party may advance to the status of a major political party if:
a. during the period of direct democracy, it sustains the lifespan of at least one Cabinet meeting the qualifications of a major political party; or,
b. during any possible period of representative democracy, it sustains the lifespan of at least one Parliament meeting the qualifications of a major political party.
2. A major political party may decline to the status of a minor political party if:
a. during the period of direct democracy, it sustains the lifespans of two Cabinets failing to meet the qualifications of a major political party;
b. during any possible period of representative democracy, it sustains the lifespans of two Parliaments failing to meet the qualifications of a major political party.
3. The Lord Chancellor may at any time remove a political party from the Register of Political Parties alltogether if it has failed to fulfill the minimum qualifications of a minor political party.
4. His Majesty's Courts may may at any time dissolve a political party, if that political party, in the judgement of the Court, develops any activity against the law, peace or public order of the Kingdom.
Section 6: Identity
Each political party shall have the right to democratically determine its own symbols, policies, motto, name, or any other issue related to its identity.
Section 7: Forums
All major political parties shall be guaranteed the equal right to their own forums.
Section 8: Commencement
1. This act shall come into force upon receiving Royal Assent.
2. In relation to the parties currently known as the Conservative Party and the Liberal Party, each shall have one month, from the commencement of this act, to meet the requirements of Section three (3) clause two (2) points b and d, as well as to provide evidence to support its compliance with point point c of that clause.
