External Relations Act (2003)
A bill to standardize processes for the development of foreign relations between His Majesty’s Government and other entities.
Be it enacted by the King's most Excellent Majesty, by and with the advice and consent of the elected representatives of His Majesty's subjects, in this first here assembled, and by the authority of the same, as follows:
Section 1: Department of State
a) The Department of State shall be the only competent office for conducting relations with external entities on behalf of His Majesty’s Government.
The Department of State is headed by the Minister of State and consists of his or her subordinates as appointed by him or her.
c) Only the Prime Minister, the Minister for State and his subordinates as so authorized, and other persons as delegated by the Prime Minister or Parliament, may represent the Kingdom of Hanover and His Majesty’s Government in dealings with external entities.
d) The Department of State is charged with pursuing the Kingdom of Hanover’s external affairs in line with the laws of the Kingdom of Hanover and any policy with regard to external affairs adopted by cabinet or as directed by the Prime Minister.
Section 2: Recognition of Foreign Nations
a) The Minister of State shall be authorized to recognize external entities and the legitimacy of their governments on behalf of His Majesty’s government.
Entities to be recognized shall have an established and permanent web presence containing clear and informative web pages on the entities policies and system of governance. The permanent web presence cannot be purely in the form of an online discussion forum.
c) Recognition must be consistent with the ‘Recognition Policy of the Government of Hanover’ as adopted by the Department of State on the 29th day of January 2003. This policy may be amended by Cabinet.
d) In deciding on recognition the Department of State will be cautious about recognizing any entity that includes elements of pure fantasy represented as fact, any elements of fantasy must be strictly separate from the operations of governance.
e) The Department of State will abstain from any involvement in entities with aggressive military policies, or any policy, official or unofficial, of racism, discrimination or deliberately offensive material.
f) The representatives of external entities must act in a civil and polite manner in all official affairs.
Section 3: Treaties and International Agreements
a) Treaties and other international agreements must be formerly signed by His Majesty the King following their endorsment by Parliament.
The Minister of State, the Prime Minister or other figure authorized by Parliament may initiate and/or participate in negotiations for the establishment and signing of international treaties and other agreements.
c) Treaties must be endorsed by an Act or Resolution of Parliament prior to signing, as required in article VI, clause three of the Organic Law of the Kingdom of Hanover, to be binding and valid.
Section 4: Miscellaneous
(a) Any person who purports to act for the Kingdom of Hanover in violation of Section 1c of this Act shall be liable to a sentence of, at the pleasure of the High Court, a minimum of an official warning, to the pain of banishment by the King from the Realm, and a fine of no less than 200 talens and no more than 4000 Talens, at the discretion of the High Court, which shall accrue to the Government.
(Notwithstanding the Organic Law provisions on the Royal pardoning power and commutation of sentence, banishment from the Realm on recommendation of the High Court shall require the Assent of the King. Banishment shall not include immediate loss of citizenship.
c) This law becomes legally binding immediately upon receiving Royal Assent.
d) This act may be cited as the ‘External Relations Act (2003)’
